People leave the scene of an accident for a number of reasons, such as panic, intoxication, a misunderstanding of what occurred, or just poor judgment. If you have left the scene of an accident for any reason, you could be facing serious criminal consequences. For this reason, it is critical to call a criminal defense attorney as soon as you can.

Leaving the Scene of an Accident

A hit and run is a crime, far more serious than a mere traffic infraction such as failing to indicate before switching lanes or failure to fully stop at a stop sign. In Illinois, if you are involved in an accident that results in property damage, you must stop and lend assistance to the person you collided with or at the very least exchange information for insurance purposes. It is also possible to be charged with leaving the scene of an accident for something as small as a minor scratch or dent that is barely noticeable.

Classifying Hit and Runs

In Illinois, hit and run crimes are separated into three classifications:

  1. It is a MISDEMEANOR crime to leave the scene of an accident when there is damage to only a person's property. If found guilty, the driver faces up to 364 days in jail and a $2,500 fine.
  2. It is a FELONY to leave the scene of an accident where there is personal injury involved. If found guilty, the driver faces up to 3 years in jail and a $25,000 fine.
  3. It is a FELONY to leave the scene of an accident that results in death. If found guilty, the driver faces up to 5 years in jail and a $25,000 fine.

Simply put, if you believe you have collided with another person. Stop your vehicle, get out, and make sure the other person is okay. Provide aide, if necessary. Accidents happen and people heal. But, fleeing the scene could cost you thousands of dollars and potentially years of your life.
